Accordingly;<\/p>\n<p>In the Health Pricing Commission&#8217;s decision, it was stipulated that the prices in the Tariff for Medicines Compounded in Pharmacies (Magistral Tariff) in MEDULA be increased by 20%, and the regulation came into effect after 5 business days.<\/p>\n<p>It is a well-known fact within the Pharmacy Community that, throughout the past period, as the Association of Compounding Pharmacists, we have made numerous verbal and written applications with justifiable reasons to the relevant authorities and made extraordinary efforts to demand pricing in the \u201cMagistral Tariff\u201d that reflects both the content and the pharmacists&#8217; professional rights. Finally, in my article titled <strong>\u201cUpdating the magistral tariff is a legal and conscientious responsibility!\u201d<\/strong> which I wrote on this subject on 13.12.2020;&nbsp;I drew attention to the fact that the chemical sector has a very dynamic structure in our country, just as in the rest of the world, and that we are adversely affected by very rapid price fluctuations depending on raw material production quantities and the supply-demand balance; stated that it is impossible to prepare medicines today based on the magistral tariff prepared according to 2015 inflation rates;&nbsp;and wrote an article stating that as the Association of Compounding Pharmacists, we are ready to contribute to the efforts to be carried out in this framework. In the continuation of my article, I touched upon the following points\u2026<\/p>\n<p>\u201cAs is known,&nbsp;according to the Law on Misdemeanors No. 5326, <strong><u>selling medical preparations and magistral formulas above the price determined by the Ministry of Health&nbsp;<\/u><\/strong>is considered an offense in pharmacy and is a ground for punitive sanctions. However;<\/p>\n<p>With the Ministry approval of the Ministry of Finance dated 23 March 2011,&nbsp;through the provision <em><strong><u>\u201cArticle 14: the prices written in the tariff and its annex schedules are republished at the beginning of each year by adding the revaluation rates published by the Ministry of Finance,\u201d<\/u><\/strong><\/em>&nbsp;the problem experienced regarding revaluation was resolved and&nbsp;the annual updating of the magistral tariff was guaranteed. Although it was stated that <strong>\u201cit was deemed appropriate that the regulations to be made after this date for the &#8216;magistral tariff&#8217;, which was prepared by TEB, is currently in force, and is used in pricing magistral products compounded in pharmacies, be updated by applying the revaluation rates determined by the Tax Procedure Law General Communiqu\u00e9 published annually by the Ministry of Finance in accordance with Tax Procedure Law No. 213, and published by the General Directorate of Pharmaceuticals and Pharmacy accordingly without requiring a new &#8216;Approval&#8217;\u201d<\/strong>,&nbsp;unfortunately, the magistral tariff has not been updated since 2015. Consequently, at this stage, the pharmacist is forced to prepare medicines at a loss in order to avoid facing punitive sanctions pursuant to the <strong>\u201cLaw on Misdemeanors No. 5326\u201d<\/strong>. There must also be a moral and legal accountability for slow-moving bureaucratic processes or authorities neglecting their duties, which cause pharmacists to face such punitive actions.<\/p>\n<p>Forcing pharmacists to compound medicines according to the 2015 prices of the Magistral tariff when preparing Magistral drugs not only causes economic losses for pharmacists, but as identified in a study conducted by our association, it is also evident that the public sector suffers significant financial losses on certain raw materials included in the tariff.<\/p>\n<p>Our association conducted a study based on the prices of raw materials obtained from two supplier companies and packaged in the smallest package sizes, summarizing what needs to be done regarding the Magistral tariff as follows:<\/p>\n<p>.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;It is important to arrange raw material names in Turkish, providing Latin names alongside them if necessary,<\/p>\n<p>\u00b7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Reducing raw materials that are repeated under the same or different names in the tariff to a single entry,<\/p>\n<p>\u00b7&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Identifying and removing raw materials that have lost therapeutic value and are no longer used today for various reasons, and replacing them with raw materials used in current treatments,<\/p>\n<p>.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Re-adding suppository compounding, which was removed from the tariff, and reviewing details such as sterilization,<\/p>\n<p>.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Pricing raw materials in the tariff not only by weight but also by volume,<\/p>\n<p>.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Implementing the Magistral SUT,<\/p>\n<p>has now become an unavoidable necessity. 13.12.2020\u201d<\/p>\n<p>Dear Colleagues; It is a reality that the 20% increase, implemented after a 5-year gap since 2015, which acts virtually as hush money and is claimed to be a price update, has caused disappointment and is far from meeting our demands and expectations outlined above.<\/p>\n<p>Namely;<\/p>\n<p>While it should have been renewed as of the end of 2016 based on the previous year&#8217;s inflation figures under the provision <em><strong><u>\u201cArticle 14: the prices written in the tariff and its annex schedules are republished at the beginning of each year by adding the revaluation rates published by the Ministry of Finance\u201d<\/u><\/strong><\/em>&nbsp;approved by the Ministry of Finance on 23 March 2011,&nbsp;this circular was disregarded and its requirements were not fulfilled. If the update were conducted annually considering inflation rates, taking into account inflation figures since 2016, this rate should have been at least 80%; ignoring this, the increase was realized at a rate of 20%, well below expectations. Our country is completely foreign-dependent in the chemical raw materials sector. At the end of 2016, the Central Bank USD exchange rate was 3.5308, whereas at the end of 2020 it was 5.9923, representing an exchange rate increase of 69.71%. In our country, keeping the magistral tariff at a low rate such as 20% is unacceptable.<\/p>\n<p>The data in our study report dated 13.12.2020 has been updated as follows after the insufficient 20% increase made to the tariff:<\/p>\n<p>625 CHEMICAL RAW MATERIALS ARE INCLUDED IN THE MAGISTRAL TARIFF;<\/p>\n<p>BEFORE THE UPDATE;&nbsp;WHILE A PHARMACIST LOSS OF UP TO 100% WAS IDENTIFIED IN <strong><u>128<\/u><\/strong>&nbsp;CHEMICAL RAW MATERIALS, THIS NUMBER BECAME <strong><u>117<\/u><\/strong>&nbsp;AFTER THE 20% UPDATE,<\/p>\n<p>BEFORE THE UPDATE; ACCORDING TO THE TARIFF,&nbsp;<strong><u>35<\/u><\/strong>&nbsp;CHEMICAL RAW MATERIALS COULD BE COMPOUNDED WITHOUT ANY PROFIT, THIS NUMBER BECAME <strong><u>43<\/u><\/strong>&nbsp;AFTER THE 20% UPDATE,<\/p>\n<p>BEFORE THE UPDATE; ONLY&nbsp;<strong><u>17<\/u><\/strong>&nbsp;CHEMICAL RAW MATERIALS WERE INCLUDED IN THE TARIFF WITHIN LEGAL PROFIT MARGINS, THIS NUMBER BECAME <strong><u>23<\/u><\/strong>&nbsp;AFTER THE 20% UPDATE,<\/p>\n<p>BEFORE THE UPDATE;&nbsp;IT WAS DETERMINED THAT THE PRICES OF <strong><u>137<\/u><\/strong>&nbsp;CHEMICAL RAW MATERIALS DECREASED IN A WAY THAT CAUSED PUBLIC LOSS, THIS NUMBER WAS UPDATED TO <strong><u>126<\/u><\/strong>&nbsp;CHEMICAL RAW MATERIALS AFTER THE 20% UPDATE,<\/p>\n<p>THE REMAINING 316 RAW MATERIALS CONSIST OF THOSE THAT HAVE LOST THEIR THERAPEUTIC PROPERTIES FOR VARIOUS REASONS OR ARE DIFFICULT TO OBTAIN, AND IT HAS BEEN REPORTED THAT PRICING THEM IS NOT POSSIBLE DUE TO THESE REASONS.<\/p>\n<p>In light of this information, we respectfully announce to the pharmacy community that the 20% increase made to the Magistral Tariff means the loss faced by pharmacists while preparing Magistral Prescriptions will continue, and that we will closely follow the price adjustment reflecting the pharmacist&#8217;s professional fee and our other demands.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 26\/07\/2021<\/p>\n<p>&nbsp;<\/p>\n<p>Pharm.
